PUBLIC NOTICE
SUBSTITUTE TRUSTEE’S NOTICE OF SALE
WHEREAS, on May 15, 2008, Rebecca Overstreet executed a Deed of Trust to Johnny M. Shell, Area Director of Rural Development, Trustee for the use and benefit of United States of America acting through the Rural Housing Service or successor agency, United States Department of Agriculture , which Deed of Trust is on file and of record in the office of the Chancery Clerk of Panola County, Mississippi, in Book 2008 and at Page 4871 thereof; and
WHEREAS, the legal holder of the said Deed of Trust and the note secured thereby, substituted Albertelli Law as Trustee therein, as authorized by the terms thereof, by instrument recorded in the office of the aforesaid Chancery Clerk in Book 2024 at Page 6959 thereof; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness secured and described by said Deed of Trust so to do, notice is hereby given that Albertelli Law, Substitute Trustee, by virtue of the authority conferred upon me in said Deed of Trust, will offer for sale and will sell at public sale and outcry to the highest and best bidder for cash, during the legal hours (between the hours of 11 o’clock a.m. and 4 o’clock p.m.), in Panola County, Mississippi, on August 19, 2026, the following described land and property being the same land and property described in said Deed of Trust, situated in Panola County, State of Mississippi, to-wit:
LOT 17 OF CHICKASAW VIEW SUBDIVISION, SECTION “A”, PHASE II, ACCORDING TO A PLAT OF SAID SUBDIVISION APPEARING ON PLAT SLIDE 135 OF RECORD IN THE OFFICE OF THE CHANCERY CLERK OF PANOLA COUNTY, MISSISSIPPI AT BATESVILLE, REFERENCE TO WHICH IS HERE MADE.
Commonly known as: 134 Pine Ridge Road Pope MS, 38658
Should the undersigned become the last and highest bidder at the foreclosure sale, the Substituted Trustee is hereby authorized to transfer and assign said bid and to convey title to said foreclosed property to the Secretary of Veterans Affairs, an Officer of the United States of America, or the Secretary of Housing and Urban Development, an Officer of the United States of America, or whomever the undersigned shall authorize. The statement in the Substituted Trustee’s Deed that the undersigned has requested transfer of its bid to grantee(s) in the Substituted Trustee’s Deed shall be binding on the undersigned and conclusive evidence in favor of the assignee or other parties thereto and that the Substituted Trustee is duly authorized and empowered to execute same.
Please be advised that the trustee will require any entity or trust bidder at this trustee’s sale to provide beneficial ownership information, documentation, and written certification as required under FinCEN’s Anti-Money Laundering Regulations for Residential Real Estate Transfers, effective for transfers to covered transferees closing on or after March 1, 2026. This requirement applies where the purchaser is a legal entity (including an LLC, corporation, or partnership) or a trust, and the transfer is not financed by an institutional lender subject to existing anti-money laundering requirements. The required information and certification must be provided to the trustee prior to issuance of the trustee’s deed upon sale. No trustee’s deed will be issued for a covered transfer until all required FinCEN information has been received and certified.
