SUBSTITUTE TRUSTEE’S NOTICE OF FORECLOSURE SALE
WHEREAS, on August 14, 2007, Anthony Kirkwood and Yolanda Kirkwood executed a certain Deed of Trust to Jeff Schofield, Trustee, for the use and benefit of American General Financial Services, Inc. which Deed of Trust is of record in the office of the Chancery Clerk of Panola County, Mississippi, on August 17, 2007, in Deed of Trust Book 2007, at Pages 9083-9086 and modified pursuant to the Modification recorded on August 22, 2013, in Deed of Trust Book 2013, at Pages 9931-9938.
WHEREAS, Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Indenture Trustee of CIM Trust 2023-R3, the current holder and/or assignee, substituted Halliday, Watkins & Mann, P.C. as Trustee by instrument recorded in the Chancery Clerk’s Office on February 17, 2026, in Book 2026, at Page 1183- Deed of Trust-J2; and
WHEREAS, Default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Indenture Trustee of CIM Trust 2023-R3, the legal holder of said indebtedness, having requested the undersigned Substitute Trustee in said deed of trust, will on April 7, 2026 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the main front door of the County Courthouse of Panola County in Batesville, Mississippi, to the highest and best bidder for cash the following described property situated in Panola County, Mississippi, to wit:
Beginning at an iron pipe on the Southwest corner of Block 34 of the old town of Panola, said point being also defined as being 1639 feet West of and 1736 feet North of the point of intersection of the center lines of Panola Avenue and Baker Street in the City of Batesville, Mississippi as shown by the official map of said City of Batesville. From said Point of Beginning run West 98.4 feet; thence North 80 feet; thence North 80 degrees and 57 minutes East 134.9 feet; thence South 40 degrees and 51 minutes East 125.75 feet; thence West 120.8 feet to the Point of Beginning. Said tract of land being located in the Southwest Quarter of Section 5, Township 9 South, Range 7 West, Panola County, Mississippi
More commonly known as: 323 Panola, Batesville, MS 38606
