PUBLIC NOTICE

SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, on or about the 23rd day of July, 2008, Ederic Kerney and spouse, Annette Kerney executed and delivered a certain Deed of Trust unto H. Kirk Moore, Jr., as Trustee, for the use and benefit of Sycamore Bank, in the principal amount of $79,457.56, filed for record on July 29, 2008 in Book 2008, Page 2418, in the land records in the office of the Chancery Clerk of Panola County, Mississippi, First Judicial District; and
WHEREAS, on or about the 12th day of April, 2013, Ederic Kerney and Annette Kerney executed and delivered a certain Deed of Trust unto H. Kirk Moore, Jr., as Trustee, for the use and benefit of Sycamore Bank, in the principal amount of $83,424.73, filed for record on May 9, 2013 in Book 2013, Page 1401, in the land records in the office of the Chancery Clerk of Panola County, Mississippi, First Judicial District, and taken in renewal and extension and not in cancellation of the instrument recorded in Book 2008, Page 2418; and
WHEREAS, on or about the 3rd day of December, 2021, Ederic Kerney executed and delivered a certain Deed of Trust unto Bridgforth Bunton & Emerson, PLLC, as Trustee, for the use and benefit of Sycamore Bank, in the principal amount of $75,693.10, filed for record on December 30, 2021 in Book 2021, Page 4763, in the land records in the office of the Chancery Clerk of Panola County, Mississippi, First Judicial District, and taken in renewal and extension and not in cancellation of the instrument recorded in Book 2013, Page 1401; and
WHEREAS, on or about the 1st day of October, 2022, BankFirst Financial Services, a Mississippi banking corporation and successor-in-interest by merger to Sycamore Bank, by virtue of the terms and conditions of the Deeds of Trust being assignable at any time without notice to the borrower, became the present owner and holder of the above indebtedness secured by said Deeds of Trust; and
WHEREAS, on the 12th day of January, 2026, BankFirst Financial Services executed and delivered to Elizabeth N. Fisher an appointment whereby the said Elizabeth N. Fisher was appointed and substituted as Successor Trustee in the aforesaid Deeds of Trust in the place and stead of the Trustees originally named therein, as shown by said appointment duly recorded in Book 2026, Page 121 as of January 21, 2026, in the land records on file in the Office of the Chancery Clerk of Panola County, Mississippi, First Judicial District; and
WHEREAS, default has been made in the payment of the indebtedness secured by said Deeds of Trust, which default continues, and BankFirst Financial Services, the legal holder of the promissory note secured by said Deeds of Trust, having requested the undersigned to sell the property described hereinafter for the purpose of satisfying the indebtedness and costs of sale.
NOW, THEREFORE, notice is hereby given that I, the undersigned Substitute Trustee, will on the 26th day of March, 2026, at the main front door of the Panola County Courthouse in Sardis, Mississippi within legal hours, offer for sale, at public outcry, to the highest bidder for cash, the following described property in Panola, Mississippi, to-wit:
A part of the West half of the Northeast Quarter of Section 18, Township 8 South, Range 7 West, Panola County, Mississippi, and being particularly described as commencing at the Northeast corner of the said West half of the Northeast Quarter of Section 18 thence run South 40 feet; thence run South 89 degrees 30 minutes 30 seconds West a distance of 290.4 feet to the East line of a public graveled road; thence run South no degrees 20 minutes West a distance of 1567.8 feet to an iron stake and the point of beginning; thence from the point of beginning run South 83 degrees 41 minutes no seconds East a distance of 292.0 feet to an iron stake in a fence line; thence run South no degrees 20 minutes no seconds West along the said fence line a distance of 119.23 feet to an iron stake; thence run South 89 degrees 30 minutes 30 seconds West a distance of 290.4 feet to an iron stake in the East right of way line of a public graveled road; thence run North no degrees 20 minutes no seconds East a distance of 150.0 feet to the point of beginning and containing one (1.0) acre, more or less.
Such title will be conveyed as is vested in me as Substitute Trustee aforesaid without warranty of any kind.
